PGA Tour Terms and Conditions

  1. Other than use in text (and not in a logo or graphic) of the name of the applicable PGA Tour Series, unless otherwise permitted under law, Licensee shall not use or display any PGA Tour mark in conjunction with the PGA Tour Data or elsewhere on the Licensee’s website(s) or in any other manner unless approved in advance by PGA Tour in each instance;
  2. Licensee shall not purport, infer or imply that the PGA Tour Data is “official,” “live” or “real-time” or make any other claims related to the timeliness of the PGA Tour Data;
  3. Licensee shall display the name of the PGA Tour event, in text only, unless otherwise permitted under law, as provided with the PGA Tour Data, or in shortened or abbreviated form, as supplied or approved by PGA Tour, where formatting or space availability requires);
  4. Licensee shall fully and properly display the name, in text only, unless otherwise permitted under law, of the applicable PGA Tour Event in connection with display of the PGA Tour Data, or in shortened or abbreviated form, as supplied or approved by PGA Tour, where formatting or space availability requires;
  5. Licensee shall not alter the PGA Tour Data so as to render it factually inaccurate (but may modify its presentation and format);
  6. Licensee shall not display or use PGA Tour Data in connection with any obscene, pornographic or offensive content or advertising, or in connection with any content or advertising related to alcoholic beverages, tobacco or illegal gambling;
  7. Licensee shall prominently display on top of the PGA Tour Data the disclaimer that “All scores are delayed 15 minutes”; providedhowever, that such requirement shall be subject to a Licensee’s legitimate space limitations;
  8. Licensee shall not sell sponsorship or display advertisements on the same page on which the PGA Tour Data is displayed to competitors of: (A) a PGA Tour Event’s title sponsor (each a “Title Sponsor”) during the week of the corresponding PGA Tour Event, or (B) PGA Tour’s Season Long Sponsor, which is currently FedEx, (such competitors collectively referred to hereinafter as, “Competitors”) in a manner in which such sponsorship remains permanently displayed on such page. For the avoidance of doubt, Licensee may sell non-permanent ads (rotating banners, etc.) that may intermittently display Competitors on the same page as Title Sponsors or FedEx; providedhowever, that, in the event such display, in PGA Tour’s reasonable opinion, appears to be sponsorship of the PGA Tour Data, PGA Tour may require Licensee to change the rotation (including the frequency of such rotation)/flight pattern of, and/or cease, such displays.
