WTA Terms and Conditions

  1. The following definitions apply to these WTA Terms and Conditions:
    1. Prohibited Person means: (a) entities or individuals that are: (i) engaged in the collection, publication or other exploitation of material that would reasonably be expected to have a material adverse effect on the reputation of the WTA or a WTA Tour player, match, tournament, event, or the integrity of such players, matches, tournaments or events for betting purposes; (ii) the subject of an investigation or proceeding for betting-related corruption or betting-related criminal offense or any other materially significant betting integrity-related investigation brought by the ITIA or any relevant betting-integrity, governmental, regulatory or gaming authority; (iii) an adverse party in litigation or arbitration involving the WTA or a WTA Tour player, match, tournament, event in respect of Unofficial Data or betting in connection with the WTA or WTA Tour player, match, tournament, event; (iv) the subject of legal or disciplinary proceedings brought by the ITF, ATP, or any Grand Slam tennis events in respect of any unauthorized in-stadium collection of unofficial data pursuant to such governing body’s rules with respect thereto; (v) suspended or serving a suspension under the WTA’s rules or the Tennis Anti-Corruption Programme (TACP); or (vi) sanctioned under the WTA rules or TACP; or (b) entities or individuals that: (i) have been convicted of betting-related corruption, betting-related criminal offenses or a criminal offense of moral turpitude by the ITIA or any relevant betting-integrity, governmental, regulatory or gaming authority; (ii) are subject of an investigation or a proceeding for betting-related corruption or a betting-related criminal offense or any other materially significant betting integrity-related investigation brought by the ITIA or any relevant betting-integrity, governmental, regulatory or gaming authority; or (iii) have a current sanction from any relevant betting-integrity, governmental, regulatory or gaming authority as to a material violation or series of violations that could reasonably be expected to call the applicable person or entity’s betting-related integrity into question.
    2. ITIA means the Tennis Integrity Unit until its replacement by the International Tennis Integrity Agency and, thereafter, the International Tennis Integrity Agency, or any successor agency thereto;
    3. Unofficial Data means any data, statistics, information or index concerning any WTA Tour player, match, tournament, event or other data which is collected, compiled, produced or distributed without consent or authorisation of the WTA or Stats Perform;
    4. WTA Data means any player, match, tournament, event or other data from the WTA Tour provided to the Licensee by Stats Perform ; and
    5. WTA Tour means the worldwide circuit of women’s professional tennis.
  2. Licensee may not sublicense any of its rights or obligations with regard to the WTA Data.
  3. Licensee may not onward supply or resale of any of the WTA Data except to its own customers.
  4. On receiving notification from Stats Perform , the Licensee will immediately discontinue the use or supply of WTA Data with respect to a particular WTA Tour player or match. For example, in the event of suspicious betting patterns on such player or match.
  5. The Licensee will not combine any WTA Data with Unofficial Data.
  6. The Licensee is granted a non-transferable, non-exclusive limited licence to use the term “Official WTA Data” when using the WTA Data.
  7. The Licensee shall not replicate or use any trade mark, badge, insignia or logo owned or used by the WTA itself or a WTA Tour player, match, tournament or event without the prior written consent of the appropriate owner of such a trade mark, badge, insignia or logo.
  8. Except as granted in paragraph 5 of these WTA Terms and Conditions, the Licensee (or any of its affiliates) shall not directly or indirectly imply a sponsorship, association or endorsement between the WTA or any WTA Tour player, match, tournament or event, on the one hand, and the Licensee (or any of its affiliates), on the other hand unless the Licensee (or any of its affiliates) has secured such sponsorship, association or endorsement rights pursuant to a separate agreement with the WTA or any WTA Tour player, match, tournament or event.
  9. The Licensee: (a) acknowledges that such intellectual property rights as exist (to the extent that they do exist) in the WTA Data does not belong to it; and (b) shall not claim or assert any intellectual property rights in the WTA Data.
  10. The Licensee acknowledges and agrees that Stas Perform shall be entitled to terminate or suspend the supply of WTA Data to it with effect from midday on the third business day after receipt of such notice if the Licensee: (a) becomes a Prohibited Person; (b) materially or persistently refuses to cooperate in good faith with any integrity-related request or directive of Stats Perform  or the ITIA; (c) fails to obtain, abide by or renew any agreement with Stats Perform  relating to the WTA Data at any point during the Term; or (d) challenges the existence of intellectual property rights in any of the WTA Data.
